Solution

Solution 1

1. What is the issue you need to consider? (1mark)

The issue that needs to be considered in this case primarily Is whether the contracts that one gets into with family are valid contracts or not? There have been cases where the court has held that contracts with family are voidable because there has been a lack of legal intention.

2. What are the relevant legal rules relating to this problem? (1 mark)

The relevant legal rule related to this problem is that a contract between family members is enforceable only when there was an intention to create a legal relationship. The intension is made out by examining the circumstances surrounding the situation. In this case, there was a valid contract between both the siblings which shows that there was a legal intention.

tional to the conditions and are not the essence of the contract are warranties. If such terms are not performed then it will not render the contract ineffective and only damages can be sought by the plaintiff.

3. What are the main cases related to this problem? (1 mark)

The leading case law in this situation is Balfour V. Balfour. The facts of the case were that a married couple came from England to Sri Lanka. The husband had to go back but the wife stayed behind the husband promised to pay wide 30 euros per month. The husband after a point did not pay the wife. The wise sued the husband. It was held in this case that there was no intension of creating a legal contractual relationship between the husband and the wife.

4. Based on this information, if Ali sues Charlie for breach of contract, will she win in court? What is your answer – yes? or no?  Explain your answer. (2 marks)

Ali can sue Charlie for Breach of contract. There was a legal contract between 2 siblings who had the intension of getting into a legally enforceable agreement as can be seen through the facts of the case. There was an intention to get into contract and prima facie the object of the agreement was also legal (if we ignore the fact that contracts which are for the object of trade restraint are void) then Charlie can be sued.
